SC dismissed former law minister PIL seeking laying down of principles in allocation of cases (Read Judgment)

A bench comprising Main Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud dismissed a PIL trying to find framing of recommendations for rational and transparent allocation of conditions and structure of benches to listen to them.

The Bench although dismissing the petition said:

In the allocation of cases and the structure of benches, the Main Justice has an exclusive prerogative. As a repository of constitutional have confidence in, the Main Justice is an institution in himself. The authority which is conferred on the Main Justice, it must be remembered, is vested in a superior constitutional functionary. The authority is entrusted to the Main Justice since these kinds of an entrustment of functions is required for the efficient transaction of the administrative and judicial operate of the Court. The greatest reason at the rear of the entrustment of authority to the Main Justice is to make certain that the Supreme Court is capable to fulfill and discharge the constitutional obligations which govern and offer the rationale for its existence. The entrustment of functions to the Main Justice as the head of the establishment, is with the reason of securing the position of the Supreme Court as an independent safeguard for the preservation of personal liberty.
